Elizabeth M. Behnke [inactive]

Elizabeth Behnke practiced in the areas of commercial leasing and commercial real estate transactions. She has had extensive experience in representing landlords and tenants in retail, office, industrial, and general commercial contexts, with an emphasis on lifestyle shopping center planning and leasing. She assisted landlords in all phases of shopping center development and operations (including acquisition, planning, covenants, conditions and restrictions, easement issues, all phases of due diligence and title issues, financing, lease negotiations, lease amendments, terminations, and extensions, and various property management issues). Elizabeth advised tenant clients in all phases of lease negotiation, including due diligence and construction issues. In addition, she has represented sellers and buyers in both large and small acquisitions of land and improved commercial real estate in connection with a variety of types of developments, including apartment complexes and retail and general commercial developments.

  • Represented national and major regional retail and restaurant tenants in negotiation of letters of intent and leases as well as managing post-execution legal matters.
  • Represented regional landlords in lease up of lifestyle shopping centers in Arizona, New Mexico, and Hawai‘i to national, regional, and local lifestyle retailers, including engagement of local counsel for jurisdiction-specific provisions.
  • Developed and refined specialty lease forms for shopping centers (including lifestyle centers), strip shopping centers, office and industrial properties.
  • Reviewed, updated, streamlined, and improved lease forms and corollary documents (e.g., covenants, conditions, and restrictions, cross easements, and use agreements) used by clients for office, shopping center, and industrial properties.
  • Represented and advised clients in special purchase & sale and leasing matters concerning streetscape, urban locations, and historic locations.
