Stephen E. Crofton

Stephen Crofton’s practice is focused in the areas of commercial litigation, insurance agent and broker malpractice, eminent domain (condemnation), insurance coverage, Indian law, and water rights. Steve has represented businesses, governmental entities and individuals in a wide variety of lawsuits involving contracts, property rights, or statutory provisions. He has handled cases in federal, state and tribal courts and before federal and state administrative agencies and arbitration panels.


Representative Professional Experience
  • Successfully defended New Zealand manufacturer of trailer springs in multi-million dollar suit by U-Haul. Defense verdict following three- week jury trial, and prevailed on appeal. Recovered attorneys’ fees.
  • Obtained favorable ruling in Superior Court and Arizona Supreme Court concerning the ownership of treated sewage effluent for use at the Palo Verde Nuclear Generating Station.
  • Obtained judgments and recovered property for commercial landlords against tenants.
  • Represented buyer in suit against large company that supplied defective shunt reactors. Obtained favorable settlement.
  • Principal attorney for owners of power plant in litigation and arbitration involving responsibility for tens of millions of dollars in costs.
  • Represented condemning authority in eminent domain cases resulting in obtaining parcels for electrical substations and wells and obtaining easements for electrical transmission lines.
  • Obtained favorable outcomes in several suits to quiet title to property.
  • Defended insurance agents, brokers and producers in dozens of professional liability cases, some of which involved claims for millions of dollars.
  • Successfully litigated a variety of insurance coverage cases in arbitration, trial court and on appeal, involving such subject areas as construction, defamation, motor vehicles, property damage and professional liability.
  • Advised insurers and insureds on numerous insurance issues.
  • Authored lead brief in case before the Arizona Supreme Court, which ruled in favor of client regarding the interconnection between appropriable and nonappropriable water.
  • Wrote amicus curiae brief for the United State Supreme Court addressing the standard for quantifying Indian tribes’ federal reserved water rights.
  • Represented various clients in federal and tribal courts on Indian law issues involving jurisdiction, immunity, water rights, dispute resolution, rights-of-way, landfills, gaming and cable television.
  • Defended flood litigation cases.
